These Terms & Conditions (“Terms”) govern your access to and use of the MenoBloom mobile and webpage (the “App”) provided by Chemify OÜ (“we,” “us,” or “our”). By creating an account, signing in, or otherwise using the App, you agree to be bound by these Terms. If you do not agree, you must not access or use the App.
1. Acceptance of Terms
1.1 Eligibility. You must be at least 13 years old to use the App.
1.2 Agreement. By signing in, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy.
2. Account Registration
2.1 Account Information. You agree to (a) provide accurate, current, and complete information when creating your account and (b) maintain and promptly update your information.
2.2 Security. You are responsible for safeguarding your password and any devices you use to access the App. You must notify us immediately of any unauthorized use of your account.
3. License & Use of the App
3.1 License Grant. We grant you a limited, non‑exclusive, non‑transferable, revocable license to access and use the App for personal, non‑commercial purposes, subject to these Terms.
3.2 Restrictions. You shall not:
- Copy, modify, or distribute the App’s code or content.
- Reverse engineer, decompile, or disassemble the App.
- Use the App to violate any law or infringe any rights.
- Use bots or automated scripts to access or use the App.
4. User Content
4.1 Responsibility. You are solely responsible for all content you post, share, or transmit through the App (“User Content”).
4.2 License to Us. By submitting User Content, you grant us a worldwide, royalty‑free, sublicensable, and transferable license to use, reproduce, modify, distribute, and display that content for the purposes of operating and improving the App.
4.3 Prohibited Content. You must not post content that is unlawful, defamatory, abusive, harassing, or otherwise objectionable. We reserve the right to remove such content and suspend or terminate accounts at our discretion.
5. Intellectual Property
5.1 Ownership. All App-related intellectual property rights (including trademarks, service marks, and logos) are owned by Chemify OÜ or its licensors.
5.2 Feedback. If you provide suggestions or feedback regarding the App, you grant us a perpetual, irrevocable, royalty‑free license to use such feedback.
6. Disclaimers & Limitation of Liability
6.1 “As Is” Basis. The App is provided on an “as is” and “as available” basis without warranties of any kind.
6.2 No Warranty. We expressly disclaim all warranties, whether express, implied, statutory, or otherwise, including merchantability, fitness for a particular purpose, and non‑infringement.
6.3 Limitation of Liability. To the maximum extent permitted by law, Chemify OÜ and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App. All information provided by the App (MenoBloom) is of a general nature and is furnished only for educational/entertainment/general wellness purposes only. No information is to be taken as medical or other health advice pertaining to any individual specific health or medical condition. You agree that use of this information is at your own risk and hold Chemify OÜ and the App harmless from any and all losses, liabilities, injuries or damages resulting from any and all claims.
7. Indemnification
You agree to defend, indemnify, and hold harmless Chemify OÜ and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or in any way connected with your violation of these Terms or your use of the App.
8. Termination
8.1 By You. You may delete your account at any time via the App’s settings.
8.2 By Us. We may suspend or terminate your access for any reason, including breach of these Terms, without prior notice.
8.3 Effect. Upon termination, your right to use the App will immediately cease. Sections 4, 5, 6, 7, 9, and 10 will survive termination.
9. Governing Law & Dispute Resolution
9.1 Governing Law. These Terms and any dispute arising out of them are governed by and construed in accordance with the laws of the Republic of Estonia, without regard to conflict‑of‑law principles.
9.2 Venue. Any dispute will be brought exclusively in the courts of Tallinn, Estonia.
10. Changes to These Terms
We may revise these Terms from time to time. The “Last updated” date at the top will reflect revisions. Continued use of the App after changes constitutes acceptance of the updated Terms.
